Notice of Privacy Practices (HIPAA)
NOTICE OF PRIVACY PRACTICES
Effective September 15, 2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This notice applies to Bryan Bigham Physical Therapy, LLC, doing business as Bigham Mobility, and to Stephen Bryan Bigham, PT, DPT, MHA, a physical therapist licensed in Texas who provides in-home outpatient physical therapy and telehealth services. We are required by law to protect the privacy of your protected health information (PHI), to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect.
How we may use and disclose your health information without your written authorization
Treatment. To provide and coordinate your care. For example, Bryan may send your evaluation and progress notes to your physician or surgeon, discuss your plan with a home health nurse, or share your home program with another provider treating you.
Payment. To bill and collect payment for services. This practice is self-pay, so payment use is typically limited to invoices, receipts, and, at your request, an itemized statement or superbill you may submit to your insurer.
Health care operations. For quality review, licensure, credentialing, audits, training, and the ordinary business operations of the practice.
Individuals involved in your care. With family members, a caregiver, or another person you identify, limited to the information that is directly relevant to their involvement. If you are present and able to make decisions, we will ask you first or give you a chance to object. In an emergency, or if you cannot make decisions for yourself, we will use professional judgment.
Appointment reminders and follow-up. To call, text, email, or leave a voicemail about scheduled visits, home program follow-up, or treatment alternatives. Tell us if you prefer a specific method or a specific phone number.
As required by law. Including public health reporting, communicable disease reporting, reporting suspected abuse, neglect, or exploitation of a child, an elderly person, or a person with a disability as required by Texas law, responding to court orders and lawful subpoenas, workers’ compensation claims, health oversight activities of agencies such as the Texas Board of Physical Therapy Examiners, law enforcement requests permitted by law, coroners and medical examiners, organ donation, serious threats to health or safety, and specialized government functions.
Uses that always require your written authorization
We will not use or disclose your PHI for marketing, we will not sell your PHI, and we will not disclose psychotherapy notes, without your written authorization. Any other use not described in this notice also requires your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.
We will not use photographs, video, or your story in any advertising or on this website without your separate written authorization.
Your rights regarding your health information
- Inspect and copy. You may inspect and get a copy of your record, including an electronic copy. We will respond within 15 days as required by Texas law, which is faster than the federal 30-day standard. We may charge a reasonable, cost-based fee.
- Amend. You may ask us to correct information you believe is wrong or incomplete. We may deny the request, and if we do we will tell you why in writing and you may file a statement of disagreement.
- Accounting of disclosures. You may request a list of certain disclosures we made in the six years before your request.
- Request restrictions. You may ask us to limit what we use or disclose for treatment, payment, or operations, or to limit what we tell a family member. We are not required to agree, except that we must agree to withhold information from a health plan when you have paid for a service in full out of pocket.
- Confidential communications. You may ask us to contact you in a specific way or at a specific address. We will accommodate reasonable requests.
- Breach notification. You will be notified if a breach compromises the privacy or security of your information.
- Paper copy. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
To exercise any of these rights, contact us in writing at the address below.
Care in your home and by video
Because visits take place in your home, other people in the house may see or overhear parts of your visit. Tell Bryan if you would like a visit conducted privately and he will accommodate that where the home allows. Telehealth visits are conducted over a platform that supports encrypted, HIPAA-compliant sessions. Please choose a private location for video visits. Sessions are not recorded without your written authorization.
Email and text message are not secure. If you ask us to communicate with you by email or text, you accept that risk, and you may withdraw that permission at any time.
Texas-specific protections
Texas law, including the Texas Medical Records Privacy Act and the Texas Physical Therapy Practice Act, gives you protections in addition to HIPAA. Where Texas law is more protective, we follow Texas law. Records are retained for the period required by Texas rule for physical therapists.
Complaints
If you believe your privacy rights have been violated, contact us first. You may also file a written complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, DC 20201, or at hhs.gov/ocr/privacy/hipaa/complaints, or with the Texas Attorney General. You will not be retaliated against, and your care will not be affected, for filing a complaint.
Changes to this notice
We may change this notice and make the new notice apply to information we already have, as well as information we receive in the future. The current notice will always be posted on this page with its effective date.
